This SMS Privacy Policy describes how Seacap ("Seacap," "we," "us," or "our") collects, uses, and protects your mobile phone number and related information in connection with our text messaging (SMS) program. This policy supplements our general Privacy Policy and applies specifically to our SMS communications.

1. Program Description

By providing your mobile phone number and opting in (via web form, verbal consent, application submission, or reply to a message), you consent to receive SMS text messages from Seacap related to:

  • Business funding offers and follow-ups
  • Application status updates
  • Account servicing and payment reminders
  • Promotional offers and re-engagement messages

Message frequency varies depending on your interactions with us.

Message and data rates may apply, based on your mobile carrier plan.

2. Consent

Consent to receive SMS messages is collected when you:

  • Submit a funding application or inquiry through our website or a partner referral
  • Provide your phone number to a Seacap representative
  • Opt in through a web form or landing page
  • Reply to an SMS message from us with consent language (e.g., "YES")

Consent to receive text messages is not a condition of obtaining any funding, product, or service from Seacap. You may still work with us by phone, email, or in writing if you do not opt in to SMS.

3. How to Opt Out

You may opt out of SMS messages at any time by replying:

STOP

to any message you receive from us. After you reply STOP, we will send you a one-time confirmation message that you have been unsubscribed, and you will no longer receive SMS messages from that number unless you opt in again.

You may reply HELP to any message for assistance, or contact us directly using the information in Section 7.

4. How We Use Your Mobile Information

We use your mobile phone number and message activity to:

  • Send you the communications described in Section 1
  • Respond to inquiries and provide customer support
  • Maintain compliance records of consent and opt-out status
  • Improve the relevance and timing of our outreach

5. How We Share Your Mobile Information

We do not share, sell, or disclose mobile phone numbers or SMS opt-in data with third parties for their own marketing or promotional purposes.

Your mobile information may be shared with:

  • Service providers who operate our SMS platform and deliver messages on our behalf (e.g., SMS gateway/messaging providers)
  • Funding partners or capital providers directly involved in processing your application, where necessary to service your request
  • Legal or regulatory authorities, when required by law

All other categories of data sharing are governed by our general Privacy Policy.

6. Data Security and Retention

We maintain reasonable safeguards to protect your mobile phone number and associated consent/opt-out records. We retain this information for as long as necessary to service your account, honor opt-out requests, and comply with applicable telemarketing and carrier compliance requirements (including 10DLC recordkeeping standards).
